What state agency handles Probate Filings?
Most states have an agency known as the Office of the Register of Wills. They work hand in hand with the Probate Court, also known as the Orphans Court, to settle the estate. The probate process is the legal process of settling the final affairs of the decedent (the deceased).
How long does it take to probate an estate?
Probate regulations are mandated by and different in every state. Most states regulations expect the estate to be settled within nine to eighteen months. The Internal Revenue Service (IRS) also promulgates estate regulations but these are focused on tax law and the filing of the decedents tax returns.
